Description: Digital Fair Repair Act

House Bill 2026 creates the Digital Fair Repair Act. The legislation requires original equipment manufacturers (OEM)s to make available to any independent repair provide or owner of equipment:

1. the same diagnostic and repair documentation in the same manner as the information is made available to the manufacturer’s authorized repair providers
2. parts, inclusive of any updates to the embedded software of the parts, upon fair and reasonable terms
3. all diagnostic repair tools that the OEM makes available to its own repair or engineering staff or to an authorized repair provider

The legislation also requires an independent repair provider that purchases or acquires embedded software to notify the owner of the equipment in writing of warranties prior to performing services on digital electronic equipment.
